IMHO, it seems like Marvel may be going in a typical direction I forgot about; that is, change the distinctive look of the character in question and continue. The licensees that hold the rights don't have to give their blessings for it (although that coulda happened) all you gotta do is change stuff up and use the story/background Marvel came up with those many years ago. They sorta did this with Micronauts, but they didn't bother to rename/redesign the toys and only the characters Marvel made (there was no "Arcturus Rand" or "Marionette" or "Bug" figures, even though rumor had it Bug was a supposed representation of Galactic Defender).
As for the name, ROM is pretty non-specific and as Sims pointed out, there wasn't much to the toyline besides one (cool) figure and little to no backstory (Marvel came up with all that). It could be brought to courts, but I doubt it (at least I hope it doesn't get bought). The only thing is I'd like to see the whole armor and decide if it was cool for my tastes and yes, I know that is subjective, but ROM is from "my time" and I hope I can live with it at least (I'd probably have a larger visor from that one pic we got more in tune with his former self, but I can let that slide).
I remember space knight armor was as different, yet similar as Acroyear armor from Micronauts (well, the helmets had variances. Thumbs up to Acroyear down below). This is how I had hoped Mandolorian armor woulda been handled in clone wars (and even EU) but unfortunately, it isn't. For the space knights, there were design similarities in there armor/uniform but they retained differences. It wouldn't be too far a stretch to say ROM got replacement armor or a more modern replacement with a different look.
Not trusting Pym is probably a good rule of thumb at any time. I don't have anything against Pym, I'm just sayin'.

So...no. They made ROM look like the wrong space knight.
More recent uses of Spaceknights have had an irritating sameyness in their look, and that image seems to share in the conformity. I think it's a mistake to move away from the visually distinct designs of the original series.

Also one of Marvel's signature moves to completely blow the surprise way ahead of time.
and I mean normally this kind of "clue" would be completely meaningless, but if they're putting a pic of Rom in there and calling him by name, doesn't that mean they must have gotten the trademark back? or...they just dropped themselves into another stupid lawsuit I guess. *shrug*

There are too many issues of continuity with this panel they chose to show to not be a red herring of some kind
