Early drafts of the script apparently involved the Skrulls and the shape-shifting was a big part of the story. There may be some legal issues involved with using the Skrulls (they seem to be tied up with the Fantastic Four, whose movie rights are owned by Fox, not Marvel) but I see no reason they can't be the Chitauri. Plus, The Ultimates is obviously a huge influence on the recent Marvel movies, and the Chitauri are the baddies in that. (Of course, we might get them AND frost giants.)
How about that movie game that was cancelled a while ago? The main enemies were the Skrulls.
